TERMS AND CONDITIONS

We reserve the right to change our rates, terms and conditions without prior notice.
The client agrees to abide by these terms and conditions for all services provided by 33 Interactive.

PROJECT ACCEPTANCE & PAYMENTS

    • We will provide the client with a formal estimated quotation and a project-related briefing (if applicable) to start the project.
    • The quotations will remain valid for 30 days.
    • We require a non-refundable 50% deposit as specified in the quotation to secure the project.

    • The project timeline specified in the quotation only includes business days, excluding weekends and public holidays. The project timeline will extend if we wait for the client to provide the necessary content.
    • The final payment will be due upon completion of the project.
    • Any additional or custom work not included in the original quotation will be charged separately.

PROJECT REQUIREMENTS

    • Clients must provide content (such as text, media, and other data) with necessary copyright and trademark permissions.
    • We are not responsible for any claims that may arise if the client has not obtained all the required copyright or other permissions.
    • The client agrees to select only one final design. Any unused demo designs will remain the property of 33 Interactive. There is a limit of five demo designs for logos, three for logo redesigns, email signatures, and business cards, and one for letterheads, brochures, advertisements, or special requests.
      Our hourly rates will apply if the number of demo designs exceeds these limits.
    • We retain the copyright for the final design until full payment is received.
    • We may use any design for promotion or portfolio purposes.

SUPPLY OF CONTENT

    • The client agrees to provide text for their project in a digital format. The text should be as close as reasonably possible to the final draft, ensuring that the content is accurate and that spelling and grammar are correct.
    • The client agrees to supply photos/images/videos in the highest resolution electronic format possible. We will communicate any problems regarding quality.
    • Please refrain from providing “autogenerated” content designed for social media for printing projects, as the resolutions are too low.
    • We offer copywriting services and stock media at an additional cost.

RIGHTS OF REFUSAL

Our project designs will not include immoral, offensive, obscene, or illegal designs, text, images, or other data. All advertising material must conform to the standards set by the relevant advertising standards authorities. We also reserve the right to refuse submitted material without providing a reason.

 

DOMAIN REGISTRATION

The client understands that we can only register available domains. We will provide options as close as possible to the client’s original choice.

 

DOMAIN & EMAIL HOSTING

Domain Name Yearly Renewal / Domain Hosting:
Your domain name has been purchased and secured for a year. We manage your domain’s registration details and point it to your website’s files, which we host on our servers.

    • Yearly domain renewals are due one day before the expiration date and will be invoiced 30 days in advance.
    • If the renewal payment is not made by the expiration date, the registrar will automatically suspend the account, which may result in the loss of any website content/data and emails. The client acknowledges that they are responsible for any penalties incurred and the costs associated with redoing any lost website content/data during this process.
    • Please make payment arrangements as soon as possible.

Domain and Email Hosting / Web Hosting:
Our standard hosting package is a service that provides the actual server space to store your website’s files, content, and data, making it accessible on the internet.

    • Up to 5 GB of total storage for all website files and email data combined, per main domain.
    • Annual updates for PHP and SSL certificates to maintain security and compatibility.
    • We provide basic technical support for your email accounts, which includes: Creating new email accounts (initial setup/settings) and resetting email account passwords.

Client Responsibilities and Management

    • The client is responsible for actively managing their email accounts and website data to ensure the total storage usage does not exceed the disk space on the server.
    • Should the total combined storage usage (website and emails) exceed 5 GB, an additional fee per GB will be charged.

Billing and Suspension Policy

    • Monthly or yearly hosting fees are due upon receipt of the invoice.
    • We provide a 30-day grace period following the invoice due date. If payment has not been received by the end of this grace period, the hosting account will be manually suspended immediately.
    • Account suspension results in the deactivation of the client’s website and all associated email accounts.
    • We assume no responsibility for any loss of data, content, or business interruption that may occur during the period an account is suspended due to non-payment.
    • To restore services, the Client must make the overdue payment in full. We advise making payment arrangements as soon as possible to avoid disruption of service.

Website Maintenance:
Website maintenance is a service where we update your website system (such as the WordPress theme, core software and plugins). These updates are crucial for enhancing security, ensuring compatibility with the latest PHP software, improving website performance, and introducing new features and functionalities if available.

    • We will schedule the preferred date and time with the client if an update is necessary or if they request one at our hourly rate.
    • The client understands that it is crucial to update their website system at least once a year.

Website Updates:
Website updates include content changes (such as text, media, and other data) and “look and feel” improvements (such as redesigning the layout, updating the colour scheme, and improving the overall visual appeal) after the original website development.

 

    • The client will have access to the website and be able to update text and media (photos/images/videos).
    • We offer website content and improvement updates at our hourly rate.

SECURITY

    • We offer hosting services through trusted third-party companies that ensure security measures and advanced tools to protect domains (emails and websites) from malware, viruses, and bots.
    • The client is responsible for installing the latest anti-virus software on their devices.
    • The client understands that requesting a password reset regularly enhances security.

SEARCH ENGINE SUBMISSION

    • We will index the website once development is complete and the final payment has been made.
    • The client understands that the default submission will only generate organic search results.
    • We offer search engine marketing (SEM) campaigns for improved search results at an additional cost.

BUSINESS SOCIAL MEDIA PAGE

    • After we finish setting up, the client will manage the page.
    • We offer post-management and ad campaign services at an additional cost.

CANCELLATIONS

    • Please send the cancellation notice to angelique@33interactive.co.za
    • The client agrees to pay for all work completed once we receive the cancellation notice.
    • The client is responsible for the entire project cost or outstanding invoices if they do not provide a cancellation notice.
